1. Agreement to Terms
By accessing or using the services provided by Heath Landscaping, you agree to comply with and be bound by these Terms and Conditions. Our services include website usage, consultation, landscaping design, installation, and ongoing maintenance. If you do not agree with any part of these terms, you must discontinue use of our site and services immediately.
2. Service Estimates and Contracts
All landscaping projects are subject to a formal estimate. Estimates are valid for 30 days from the date of issuance. A signed service contract is required for all projects exceeding a specific value, outlining materials, labor costs, and projected timelines. Heath Landscaping reserves the right to adjust estimates if unforeseen site conditions arise during the performance of work.
3. Payment Obligations
Payment schedules are defined in the specific service contract. For large-scale installations, a deposit is typically required before work commences. Maintenance services are billed on a monthly basis. Late payments are subject to a standard interest rate as allowed by law. We accept various payment methods including check, bank transfer, and major credit cards.
4. Intellectual Property Rights
Unless otherwise stated, Heath Landscaping and/or its licensors own the intellectual property rights for all material on this site, including landscape design plans, photography, and written content. These rights are reserved. You may access this from Heath Landscaping for your own personal use subjected to restrictions set in these terms and conditions.
5. Liability and Warranties
Heath Landscaping warrants that all services will be performed in a professional manner following industry standards. We provide specific warranties for plant health and hardscape structural integrity as outlined in your contract. We are not liable for damage caused by excessive weather conditions, customer neglect, or utility issues beyond our control.
6. Termination and Cancellations
Either party may terminate ongoing maintenance services with 30 days' written notice. Project cancellations are subject to forfeiture of the deposit and billing for materials already purchased or work already performed. Heath Landscaping reserves the right to terminate services immediately for non-payment or site safety concerns.
